Other terms apply only if expressly confirmed by us. Verbal collateral agreements
require our confirmation. We are entitled to withdrawal in case of mistakes
in writing or printing and of miscalculations on our website.
Prices
The prices indicated in the shop are given in EURO and include the current VAT for EU nations on each article charged in the case of prompt cash payment, however they
exclude shipping costs. The offers are not binding and subject to alteration
without notice.
Reservation of Property Rights
The delivered goods remain in the property of aeroware until the payment
has been made in full.
Data Protection
According to § 28 of the German Federal Data Protection Act (FDPA), we point
out to the fact that, in the course of business, the required data is processed
and stored by means of electronic data processing equipment as requested by
German § 33 (FDPA). As a matter of course we are committed to protecting your
privacy, meaning personal data is treated confidentially and is not disclosed
to third parties.
Deliverability
Orders are executed as fast as possible. Yet it is impossible to avoid delays
or delivery problems of our suppliers in all circumstances. In such a case, we are entitled to partial
or subsequent deliveries. Any liability for disprofit on account of delayed
deliveries or non-deliveries is ruled out. Payments that have already been made
will be immediately reimbursed if your article cannot be delivered.
Right of Revocation
You are entitled to withdraw from the sales contract within a maximum of two weeks either by means of a written notice (e.g. letter, fax or e-mail)
or by sending the products back to the seller. You need not give reasons for your revocation. The deadline for returning goods starts
upon receipt of these instructions. It is sufficient to send back your order until the deadline. Please direct your revocation to:

In case of a verified revocation, buyer and seller are both liable to send
back the rendered services including compensation for signs of usage (e.g. interest)
where applicable. In case the buyer is not able to return services received
from the seller in full or only in worsened condition, the buyer will be held
to pay compensation for the value. This rule is not applicable if the worsened
condition of a product can be solely traced back to the action of testing the product under
the conditions which would have been possible in a store. Yet be reminded that
you can avoid the compensation for impairment by not making use of a product in the way an
owner does and refrain from anything that reduces its value.
Mail back all items that can be sent by mail/parcel. If you send back goods
with a value less than 40 EURO altogether, you have to pay for the return, provided that
the goods delivered are the goods you ordered. Otherwise we pay for returning the goods.
Goods that cannot be sent by mail will be picked up.
The right of revocation does not apply to audio or video media (e.g. CDs, video
cassettes, DVDs) or to software opened by the orderer, furthermore products
transmitted via online-services (e.g. software, picture or video-download) and
to items produced especially for you (e.g. software or design-articles).
Warranty
The legal warranty period is 2 years and begins with the delivery of the goods.
During this period of time, all the faults that are subject to the obligation
of warranty will be remedied completely free of charge. Your warranty claims
are limited to supplementary performance in the first instance. In case the supplementary
performance fails, you are entitled, at your own choice, either to withdraw
from the sales contract or to a reduction of the purchase price.
Payment
Payment can be made either by credit card, direct debit, payment in
advance, giro or Paypal. Payment is due upon the
order and handled by our partners Ogone, Elavon and Intercard Telego.
- Credit Card (Visa, Mastercard)
With your order, Ogone/Elavon will forward your payment information
to your credit card institution.
- Direct Debit / Giro
With your order, Intercard/Telego will enter the debit entry
at your banking institution.
- Payment in Advance
You make an advance payment directly to the account of United Online Services
(UOS). You will receive the the banking information upon placing your order.
- Invoice
Payment by invoice is only possible after special agreement, after your first
order and only if the purchaser is more than 18 years old. Delivery address, home
address and billing address have to be identical and located within Germany.
Paying by invoice is not possible for services transmitted online (e.g. software
for download) and for buying gift certificates. Make your payment to
our company account within 7 days after receiving the invoice. If you pay
per invoice, aeroware will audit and evaluate your data and
may exchange data with credit agencies on due cause.
All goods remain the property of aeroware until the outstanding amount is payed
in full.
Applicable Law
German law applies excluding the UN purchase law.
